Aylesva Care is not a licensed medical provider, hospital, home health agency (HHA), hospice facility, nursing home, pharmacy, or clinical care provider under federal or state law. Aylesva Care does not employ physicians, registered nurses, or licensed medical practitioners, nor does it deliver medical diagnoses, prescribe medication, render clinical treatment, or direct medical care plans.

2. Non-Insurance & Non-Prepaid Health Plan Notice: Aylesva Care services, concierge packages, and platform memberships do not constitute health insurance, a health maintenance organization (HMO) plan, a prepaid health service contract, or a Medicare/Medicaid/private insurance substitute under U.S. state insurance codes. Aylesva Care does not underwrite healthcare costs, reimburse medical expenses, or guarantee insurance coverage. All fees paid to Aylesva Care represent non-clinical administrative software and concierge facilitation fees only.

3. Third-Party Independent Provider Severance & Vicarious Liability Shield: All personal care assistance, home support, transportation, and non-medical care services coordinated through Aylesva Care are performed strictly and independently by autonomous third-party individuals, home care agencies, or local care providers ("Third-Party Providers"). Third-Party Providers are independent contractors and are not employees, legal agents, or joint venturers of Aylesva Care. Aylesva Care does not direct, supervise, or control daily care routines or clinical decisions. AYLESVA CARE EXPRESSLY DISCLAIMS ALL VICARIOUS LIABILITY, DIRECT LIABILITY, AND NEGLIGENT CREDENTIALING CLAIMS ARISING FROM THE ACTS, OMISSIONS, NEGLIGENCE, OR MISCONDUCT OF ANY THIRD-PARTY PROVIDER.

4. Emergency Medical Disclaimer (Not a 911 / Life-Safety Service): AYLESVA CARE IS NOT AN EMERGENCY RESPONSE SYSTEM, TELEHEALTH TRIAGE PORTAL, OR 911 DISPATCH SERVICE. IN THE EVENT OF AN IMMEDIATE MEDICAL EMERGENCY, ACUTE ILLNESS, OR LIFE-THREATENING CONDITION, USERS AND CARE RECIPIENTS MUST IMMEDIATELY DIAL 911 OR GO TO THE NEAREST HOSPITAL EMERGENCY ROOM. AYLESVA CARE ASSUMES NO RESPONSIBILITY FOR EMERGENCY DISPATCH DELAYS OR IMMEDIATE LIFE-SAVING INTERVENTIONS.

5. Mandatory Binding Individual Arbitration & Class Action Waiver (FAA): PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS. Any dispute, claim, or controversy arising out of or relating to your use of aylesva.com or Aylesva Care services shall be resolved exclusively through final and binding individual arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules, governed by the Federal Arbitration Act (9 U.S.C. § 1 et seq.). YOU EXPRESSLY WAIVE ANY RIGHT TO COMMENCE, JOIN, OR PARTICIPATE AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING AGAINST AYLESVA.

TCPA Communications & Electronic Consent: By submitting your contact or care request information on aylesva.com, you provide your express written consent authorizing Aylesva Care and its designated Third-Party Providers to contact you via telephone, automated interactive voice systems, text messages (SMS/MMS), and email at the contact details provided, including for administrative, marketing, and care coordination purposes, using automated dialers or artificial/prerecorded voice technology. You acknowledge that consent is not a required condition of purchasing any service, and you may opt out at any time.

7. UDAP Non-Reliance & Integration Clause: Service illustrations, care availability, or timeline estimates displayed on aylesva.com are non-binding, hypothetical analytical estimates provided for contextual reference only. User expressly warrants that: (i) user is selecting third-party care solutions based upon its own independent due diligence; (ii) user has not relied upon any oral statements, marketing copy, or estimates provided by Aylesva Care; and (iii) user agrees to defend, indemnify, and hold harmless Aylesva Care from any third-party bodily injury, property damage, or negligence claims.
